TO THE FULLEST EXTENT PERMITTED BY LAW, VOYENNA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, ENHANCED, OR SIMILAR DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, PRODUCT MISUSE, PLATFORM ERRORS, OR FAILURE TO RECEIVE A PROMOTION OR COMMUNICATION, EVEN IF VOYENNA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, VOYENNA'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE, PRODUCTS, PROMOTIONS, CONTENT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO VOYENNA FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Voyenna from claims, losses, liabilities, damages, costs, and expenses arising out of your misuse of the website, violation of these terms, fraudulent promotion submissions, or violation of another person's rights.
Voyenna may suspend, restrict, terminate, or refuse access to the Website, promotions, communications, or offers at any time, with or without notice, if we believe you have violated these Terms & Conditions, submitted false information, abused an offer, created risk for Voyenna or others, or engaged in conduct inconsistent with the intended use of the Website or promotions. The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days, unless a shorter period is required by applicable law.
To the fullest extent permitted by law, claims must be brought only in an individual capacity and not as a plaintiff, class member, private attorney general, or representative in any purported class, collective, consolidated, or representative proceeding. Certain jurisdictions may not allow this limitation, so it may not apply to you.
If any provision of these Terms & Conditions is found unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law. You may not assign or transfer your rights or obligations under these terms without Voyenna's prior written consent. Voyenna may assign or transfer these terms in connection with a merger, acquisition, sale, reorganization, or transfer of assets.
